Terms of Service
The terms and conditions governing the supply, installation and repair of residential garage doors by Residential Garage Doors Pty Ltd (ABN 97 702 131 600).
1. Agreement to These Terms
By engaging Residential Garage Doors Pty Ltd (ABN 97 702 131 600) ("we", "us", "our") to supply, install, service or repair a garage door, or by accepting a quotation issued by us, you ("you", "the customer") agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please contact us before confirming your booking.
2. Quotations and Estimates
- All quotations provided by us are valid for 30 days from the date of issue unless otherwise stated in writing.
- Quotations are based on the information you provide and a site assessment where one has been carried out. If site conditions differ from what was advised or observed (for example, non-standard opening sizes, structural damage, or concealed wiring), we may need to revise the quotation before work proceeds.
- Any variation to the agreed scope of work will be confirmed with you in writing before additional charges are incurred.
3. Payment Terms
- Unless otherwise agreed in writing, payment is due as specified on your invoice.
- For supply-and-installation jobs, a deposit may be required to secure materials and book an installation date.
- Invoices are payable within 7 days of issue unless other arrangements are confirmed in writing.
- Overdue accounts may attract reasonable administrative and collection costs, and further work may be suspended until outstanding amounts are settled.
- We accept payment by bank transfer and card. We do not handle cash on site where this can be avoided.
4. Supply of Goods
- Garage doors, openers, remotes and associated hardware supplied by us are new unless expressly stated otherwise in writing.
- Product colours, finishes and designs may vary slightly from samples or images shown. Manufacturer tolerances apply.
- Lead times for special-order or custom-sized doors vary by manufacturer. We will advise you of the estimated delivery timeframe at the time of ordering; delays caused by manufacturers or freight carriers are outside our control.
- Risk in the goods passes to you on delivery or installation at your property. Title passes on receipt of full payment.
5. Installation and Repair Work
- Our technicians will carry out work with reasonable care and skill, in accordance with manufacturer specifications and applicable Western Australian requirements.
- You agree to provide safe, reasonable access to the work area, including clear removal of vehicles and stored items from the garage and driveway where required.
- You must inform us of any known hazards at the property, including asbestos, unstable structures, live electrical wiring or underground services. Additional costs arising from undisclosed hazards may be passed on.
- For repairs, we will diagnose the fault and advise you of the recommended remedy before carrying out work beyond the agreed scope.
- Where an existing structure, opening or frame is defective and affects the safe installation or operation of a new door, we will discuss rectification options with you before proceeding.
6. Australian Consumer Law — Your Consumer Guarantees
Nothing in these Terms of Service excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any equivalent state or territory legislation that cannot be lawfully excluded.
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with either goods or services, you are entitled to cancel your order, reject the goods, obtain a refund for the goods or a recomputed price for the service, or have the goods repaired or the service resupplied. For minor failures, we may choose to remedy the failure within a reasonable time or provide a refund.
Where goods we supply are accompanied by a manufacturer's warranty, we will provide reasonable assistance in making a warranty claim. Manufacturer warranties are in addition to, and do not limit, your rights under the Australian Consumer Law.
7. Workmanship Warranty
In addition to your statutory consumer guarantees, we warrant our installation and repair workmanship against defects arising from faulty workmanship for a period of 12 months from the date of completion, provided the door and its components have been used for their intended residential purpose and maintained in accordance with our care guidelines. This warranty does not cover fair wear and tear, misuse, storm or impact damage, unauthorised modification, or lack of routine maintenance such as lubrication and balance checks.
8. Cancellations and Rescheduling
- You may cancel or reschedule a booked installation or service visit by giving us at least 48 hours' notice. Later cancellations may attract a reasonable fee to cover labour scheduling and, for special-order goods, non-refundable supplier costs already incurred.
- Where custom-made goods have been ordered specifically for your property, the full cost of those goods may be payable if the order is cancelled after manufacture has commenced.
- We may need to reschedule bookings due to severe weather, supplier delays, or other events beyond our reasonable control. We will contact you promptly to arrange an alternative date.
9. Limitation of Liability
To the extent permitted by law, and subject always to your non-excludable rights under the Australian Consumer Law, our liability arising from or in connection with the supply of goods or services is limited, at our option, to the resupply of the goods or services, the cost of resupplying them, or the repair or replacement of the goods concerned. We are not liable for indirect or consequential loss, including loss of use of the garage, loss of security of stored contents, or loss of profits, except where such exclusion is not permitted by law.
10. Access, Safety and Property
- Our technicians are entitled to refuse or suspend work where the site is unsafe, including where pets, children or obstructions prevent safe operation.
- We take reasonable care to protect your property during work. We are not responsible for pre-existing defects in surrounding structures (walls, lintels, floors, fascia) that become apparent during installation or repair.
- It is your responsibility to ensure the garage door is operated only by persons familiar with its safe use and that children are kept clear of moving door panels and openers.
11. Privacy
We handle personal information in accordance with our Privacy Policy, which forms part of these terms. Information collected is used to quote, deliver and follow up on our services and is not sold to third parties.
12. Quotes and Communications
Quotation requests submitted through our quote form are treated as enquiries only. A booking is confirmed only when we issue a written quotation or acceptance and, where applicable, a deposit is received. 13. Governing Law
These Terms of Service are governed by the laws of Western Australia and the Commonwealth of Australia. Any dispute will be resolved in the courts of Western Australia, without prejudice to your rights under the Australian Consumer Law to pursue remedies through your relevant consumer protection body.
14. Amendments
We may update these terms from time to time. The version published on this page at the time you accept a quotation applies to that engagement. Continued use of our services after changes are published constitutes acceptance of the updated terms.
